center\"\u003e\u003cp\u003e\u003cstrong\u003e关键位置摄像头当时“正测试”\u003c/strong\u003e\u003c/p\u003e\u003c/section\u003e\u003cp\u003e“进场时我们是付过款的?！?#37011女士向记者展示了一份付款记录，𶞒���分，她向该初级滑板场业主方付款�元，随即她𴶁岁的儿子便进入了初级场地进行滑板运动。\u003c/p\u003e\u003cp\u003e\u003c!--AIPOS_1--\u003e记者根据邓女士提供的一份视频记录看到，𶞒����秒，场内的孩童在滑行经过一个障碍物时发生事故，随后在孩童受伤一分多钟以后，旁边才有穿着花格衫戴帽子的成年人进入场地，查看孩童伤情后抱起离开了滑板场。在发生事故时，\u003cstrong\u003e事发地点刚好位于摄像头所拍摄区域的盲区，因此孩童具体是磕碰到了何物受伤很难判断。\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e邓女士表示，她是在孩子前往医院紧急处理后的第二天才回到现场，拨打报警电话调取了监控，却发现本来对向的两个摄像头其中有一个“正在测试”，刚好无法提供孩子受伤时更准确的视频。“孩子在医院光缝针就缝了两个多小时，\u003cstrong\u003e医生说伤口并不是牙齿磕碰贯穿的，可能是尖锐物品造成的。\u003c/strong\u003e”\u003c/p\u003e\u003cp\u003e“事故发生时场地一个工作人员都没有?！?#37011女士告诉记者，抱起她儿子的，是旁边的另外一个小孩的教练，直到她和儿子前往医院就医，都没有看到场地方的管理人员。\u003c/p\u003e\u003csection center\"\u003e\u003cp\u003e\u003cstrong\u003e场地方在履行安全保障义务上存在明显瑕疵\u003c/strong\u003e\u003c/p\u003e\u003c/section\u003e\u003cp\u003e“公示牌明确了滑板运动是一项危险的运动，这样的提示没有问题，\u003cstrong\u003e\u003c!--AIPOS_2--\u003e但是其声明中试图通过格式条款单方面免除自身责任的做法，合法性存疑。\u003c/strong\u003e该声明中‘风险自担、责任自负’等表述，虽在一定程度上提示了运动的固有风险，但其核心目的在于免除场地自身因管理过错或设施缺陷导致损害的责任?！盶u003c/p\u003e\u003cp\u003e河南通参律师事务所高级合伙人刘鹏举律师介绍，根据《中华人民共和国民法典》第四百九十七条的规定，\u003cstrong\u003e提供格式条款一方不合理地免除或减轻其责任、加重对方责任、限制对方主要权利的，该条款无效。\u003c/strong\u003e滑板场地方作为收费的公共体育场馆经营者，其保障参与者人身安全的法定义务（源自《\u003c!--SECURE_LINK_BEGIN_1--\u003e中华人民共和国民法典\u003c!--SECURE_LINK_END_1--\u003e》第一千一百九十八条）属于强制性法律规定，不能通过此类单方声明予以预先排除。因此，该声明的法律效力极其有限，尤其不能对抗因其自身违反安全保障义务而产生的责任。\u003c!--MID_AD_1--\u003e\u003c!--EOP_1--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_1--\u003e\u003cp\u003e此外，具体到本次伤害事件，\u003cstrong\u003e\u003c!--AIPOS_3--\u003e划分或者评级各方责任的关键在于场地方是否切实履行了其法定义务，以及其行为与损害后果之间是否存在因果关系。\u003c/strong\u003e刘鹏举律师表示，从现场家长对伤情的描述和场地的监控视频来看，场地方在履行安全保障义务上存在明显瑕疵。第一，滑板运动作为公认的高风险运动，其场地不仅应提供符合安全标准的设施，更应配备专业人员进行现场监督、指导与即时救助。事发时“场地内没有工作人员在现场”，这直接构成了管理和监护上的重大缺失。\u003c!--MID_AD_2--\u003e\u003c!--EOP_2--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_2--\u003e\u003cp\u003e第二，更为关键的是，孩子的伤口被指由“场地的尖锐物体”造成，若经证实确系非牙齿类的尖锐物体刺伤，这将构成场地设施存在安全隐患的直接证据，严重违反了提供安全活动环境的基本义务。\u003c/p\u003e\u003cp\u003e第三，事发区域为监控盲区，虽不直接等同于过错，但结合其他事实，它使得场地方在证明自身无过错时面临更大困难。这些管理疏漏和潜在的安全隐患，是独立于运动固有风险之外的、由场地方引发的额外风险，也正是其需要承担法律责任的主要依据。\u003c/p\u003e\u003csection center\"\u003e\u003cp\u003e\u003cstrong\u003e家长在运动中应尽合理看护义务\u003c/strong\u003e\u003c/p\u003e\u003c/section\u003e\u003cp\u003e刘鹏举律师表示，必须正视滑板运动作为“极限运动”本身的危险性。其高速度、高难度和不可避免的摔倒风险，是任何参与者（包括其监护人）在进入场地前必须充分认知和自愿接受的。\u003cstrong\u003e法律上的“自甘风险”原则在此背景下部分适用，即参与者需要自行承担在正常、规范活动中因运动固有特性而引发的常见伤害风险。\u003c/strong\u003e这一特性意味着，家长在决定让孩子参与此类活动时，负有极其审慎的评估和监护责任。\u003c!--MID_AD_3--\u003e\u003c!--EOP_3--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_3--\u003e\u003cp\u003e孩子参与此项运动时，家长需要评估孩子的年龄、身心状况、运动能力是否与运动风险相匹配，并在活动过程中尽到合理的看护义务。\u003cstrong\u003e\u003c!--AIPOS_4--\u003e如果因为家长监护的疏忽，例如，让不具备相应能力的孩子进入高阶区域，或未在旁进行必要看护而导致或加重了伤害，那么根据法律规定，可以相应减轻侵权人（即场地方）的责任。\u003c/strong\u003e因此，家长的责任并非不存在，它体现为对运动固有风险的认知承担和对被监护人安全的基本监护。\u003c!--MID_AD_4--\u003e\u003c!--EOP_4--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_4--\u003e\u003cp\u003e\u003cstrong\u003e\u003cspan
